Jury awards $2.5m to crushed boy's family
2/21/2006
A jury awarded more than $2.5 million to a couple whose 10-year-old son was crushed to death under the wheels of a commercial van four years ago.
The verdict was against the van's driver, Herbert Perry, and the American Chair Car Services Inc. According to Perry's testimony he did not see the boy. Perry stopped and a stopped sign and then proceeded until he heard something under his van and though the axle was broken. When he stopped, about 75 feet from the accident, he found the bicycle under his van.
Lawyers for the defense stated the bus driver was not at fault because he did not see the boy and the boy ran a stop sign on his bicycle. Jurors determined the bus driver was more at fault than the boy.
